A better complaints system

One of the campaigns that we chose to focus on this year is helping to solve the issue of sexual harassment on campus, with us having a clear view that one of the ways in which we can do so was through the implementation of a better and more independent complaints procedure.

As a society, and as students at the University, we have heard about dozens of cases that have not been dealt with appropriately or where victims felt as if they could not report issues due to problems with the disciplinary system.

One of the key issues that we have is that our complaint procedures allow the usage of NDAs. These are legal agreements that, when victims sign, mean the case cannot be talked about and that doing so can have legal consequences. The UK Government recognises that these are used to silence students, with the BBC finding that a third of Universities used these agreements in 2020.

We believe that universities shouldn’t be using Non-Disclosure Agreements (NDA’s) to silence victims of sexual misconduct. Universities in England are already pledging to end the use of NDA’s in sexual misconduct cases and Aberystwyth University should join them.

We also believe that the University needs to implement a better complaints process and prioritise student wellbeing.

Gwell system ar gyfer cwyno

Un o’r ymgyrchoedd y dewisom ganolbwyntio arno eleni yw helpu i ddatrys y mater o aflonyddu rhywiol ar y campws, ac roedd gennym farn glir mai un o’r ffyrdd y gallwn wneud hynny yw drwy roi trefn gwyno well a mwy annibynnol ar waith.

Fel cymdeithas, ac fel myfyrwyr yn y Brifysgol, rydym wedi clywed am ddwsinau o achosion nad ydynt wedi cael eu trin yn briodol neu lle’r oedd dioddefwyr yn teimlo fel pe na baent yn gallu adrodd am faterion oherwydd problemau gyda’r system ddisgyblu.

Un o’r materion allweddol sydd gennym yw bod ein gweithdrefnau cwyno yn caniatáu defnyddio cytundebau peidio â datgelu (“NDA” yn Saesneg). Cytundebau cyfreithiol yw’r rhain sydd, pan fydd dioddefwyr yn arwyddo, yn golygu na ellir siarad am yr achos ac y gall gwneud hynny arwain at ganlyniadau cyfreithiol. Mae Llywodraeth y DU yn cydnabod bod y rhain yn cael eu defnyddio i dawelu myfyrwyr, gyda’r BBC yn canfod bod traean o’r Prifysgolion wedi defnyddio’r cytundebau hyn yn 2020.

Credwn na ddylai prifysgolion fod yn defnyddio Cytundebau Peidio â Datgelu i dawelu dioddefwyr camymddwyn rhywiol. Mae prifysgolion yn Lloegr eisoes yn addo rhoi terfyn ar y defnydd o cytundebau peidio â datgelu mewn achosion o gamymddwyn rhywiol a dylai Prifysgol Aberystwyth ymuno â nhw.

Credwn hefyd fod angen i’r Brifysgol roi gwell proses gwyno ar waith a blaenoriaethu lles myfyrwyr.
